IP Strategies

An IP strategy should explain how IP supports business goals. IP has no value on its own and simply filing patent and trademark applications without an idea of how they will support the business is meaningless. At Kapea, we will create an IP strategy for your company in view of its business goals, competitors and others’ IP. The scope will differ depending on size and maturity (see start-up vs billion dollar company) but it will always be linked to its business and innovation strategy.

As part of an IP strategy, or as separate modules, we can do Freedom-to-operate, Infringement Analysis and Invalidation Analysis. For this, we use the most modern tool in the market.

Freedom-to-operate (FTO)

Do you plan a new product or service? Are you entering a new market? Make sure it does not infringe on others’ patents.

Infringement

Do you have patents and want to find out if someone infringes on them? This could be a license opportunity.

Invalidation

Have you received an infringement letter from a person or company or have you discovered a blocking patent? A first step is to see whether the patent can be invalidated.

In-house IP expert

Many start-ups and SMEs do not need and cannot afford a full-time in-house IP person. We can take this role and be the link between management, R&D and outside counsel.

For larger organisations with an existing IP department, we can act as an interim IP manager or perform specialised tasks such as commercialisation and IP valuation (together with competent finance people).

IP Commercialisation

IP is a valuable asset, but the value depends on the use and the context. Transacting IP can be a way to optimise the value of those assets. Kapea has sold and licensed patents in different technology areas and has a good understanding of the secondary market and the players.

The services above are examples only. With over 35 years in different IP roles, we can offer specialised tasks depending on your needs.
